By accessing and using the Ferozzi website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website.
Use of Website
You may use our website for lawful purposes only. You agree not to use the site in any way that could damage, disable, or impair the website, or interfere with any other party’s use of the site.
Account Responsibility
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use.
Product Information
We make every effort to display our products accurately. However, we cannot guarantee that your monitor’s display of any color will be accurate, and natural variations in wood, leather, fabric, or stone are not considered defects. We reserve the right to correct any errors in pricing or product descriptions.
Order Acceptance
Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing, or suspected fraud.
Final Sale
All purchases are final sale. We do not accept returns except where required by law. Exchanges of in-stock or standard items may be requested within 7 days, subject to a 25% restocking fee. Custom and made-to-order items are final sale and cannot be cancelled once production has begun. Please review our Returns, Refunds & Claims policy and our Shipping & Delivery policy, both of which form part of your purchase agreement, before placing an order.
Electronic Communications & SMS Consent
By placing an order or scheduling delivery, you agree to receive updates, confirmations, and service-related notifications by email, SMS, or phone. Consent to receive SMS or text messages is not a condition of purchasing any goods or services. Message and data rates may apply and message frequency varies. You may opt out of SMS at any time by replying STOP, or reply HELP for assistance. You are responsible for keeping your contact information accurate and up to date.
Force Majeure
We are not responsible for delays or interruptions caused by events beyond our control, including natural disasters, pandemics or epidemics, public health orders, strikes or labor disputes, government restrictions, war, civil unrest, or logistical disruptions.
Limitation of Liability
Ferozzi shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of our website or products. Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.
Governing Law
These Terms and all purchases are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions.
Dispute Resolution & Arbitration
Any dispute arising out of or relating to these Terms or any purchase shall be resolved exclusively through binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association (AAA). To the extent permitted by law, you waive the right to a jury trial and the right to participate in any class action. Nothing in this section prevents either party from bringing an individual claim in small claims court for disputes within that court’s jurisdiction.
Before initiating arbitration, you must provide us with written notice of the dispute and allow 60 days to resolve it. This arbitration provision is a material term of the parties’ agreement; for in-store and in-home orders, it is initialed by the customer on the signed order form.
Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with the Returns, Refunds & Claims policy, the Shipping & Delivery policy, and any signed order form and invoice, constitute the entire agreement between the parties and supersede all prior statements or representations. Where an in-store or in-home order form has been signed, that signed form governs and this web version is provided for reference.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the site constitutes acceptance of the modified terms.
